WAIVER, RELEASE OF LIABILITY, AND TERMS OF SERVICE

By accessing or using the personal fitness training activities, programs, and wellness services provided by MadebySolace (Solace HOLDINGS LLC and each of their parents, subsidiaries, successors, or assigns, referred to as the "Company"), including but not limited to Lagree fitness classes, red light therapy, lymphatic drainage, and other related wellness services (the "Services"), I agree to comply with and be bound by the following Terms of Service ("Terms").

Assumption of Risk & Waiver of Liability

I understand that participation in strength, flexibility, and aerobic exercise, as well as the use of equipment and wellness services, is a potentially hazardous activity. These activities involve inherent risks, including but not limited to injury, disability, or death. I voluntarily assume all risks, known or unknown, associated with my participation in the Services and use of any equipment provided or recommended by the Providers.

I do hereby forever waive, release, and discharge the Providers, their officers, agents, members, managers, employees, contractors, representatives, and affiliates from any and all claims or liabilities for injuries or damages to my person and/or property, including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf. This release covers any claims arising out of or connected with my participation in the Services or the use of any facilities or equipment.

I further acknowledge that the novel coronavirus, Covid-19 and its variants ("Covid-19"), has been declared a worldwide pandemic by the Centers for Disease Control and Prevention. Covid-19 is highly contagious, and while the Providers have taken preventative measures to reduce its spread, I acknowledge that they cannot guarantee I will not become infected. I specifically waive any and all claims and assume any risks associated with potential contraction of Covid-19 as a result of my participation in the Services.

Health & Medical Acknowledgment

I declare that I am physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation in the Services. I acknowledge that I have been informed of the necessity of obtaining a physician's approval before engaging in physical activities or wellness treatments. I accept full responsibility for my participation, whether or not I have consulted a physician.

Certain services provided by the Providers, including but not limited to red light therapy, lymphatic drainage, and the Lagree method, may not be suitable for everyone. I acknowledge that it is my responsibility to communicate any health-related issues before participating and that my participation is voluntary and at my own risk.

Use of Facilities & Compliance with Rules

I agree to comply with all rules and procedures imposed by the Providers regarding the use of facilities, equipment, and safety guidelines. This includes any measures implemented to mitigate the spread of Covid-19. Failure to adhere to these rules may result in the termination of my participation in the Services at the sole discretion of the Providers.

The Providers reserve the right to modify, cancel, or reschedule any Services at their discretion. Reasonable efforts will be made to notify participants of such changes.

Photo & Media Release

I irrevocably consent to and authorize the Providers, their representatives, and employees to take photographs, audio, or video recordings of me and my property for any lawful purpose, including but not limited to promotion, advertising, social media, and web content, without any royalty or compensation. I assign all rights of ownership to such media to the Providers and waive any right to notice, inspection, or approval of its use.

Account & Service Usage

I understand that all bookings, reservations, or purchases of Services are subject to availability and that payment is required at the time of booking unless otherwise specified. I am responsible for maintaining the confidentiality of any account information, including login credentials, and for all activities under my account.

The Providers reserve the right to refuse or cancel Services to any individual at their discretion, including those who violate these Terms or engage in unsafe or inappropriate behavior.

Modifications to Terms

These Terms may be updated from time to time, with any modifications posted on the Providers' websites along with an updated effective date. It is my responsibility to review these Terms periodically to stay informed of any changes. Continued use of the Services after updates constitutes my acceptance of the revised Terms.

Acknowledgment & Agreement

I have read and fully understand this Waiver, Release of Liability, and Terms of Service. I voluntarily agree to all terms and conditions stated above. If I do not agree to these Terms, I will refrain from using the Providers' websites, facilities, and Services. If I have any questions or concerns regarding these Terms, I will contact the Providers directly.
